Please read this Privacy Policy carefully before using the Services or submitting your Personal Information to us. From time to time, we may supplement this Privacy Policy with additional information about our privacy practices related to a particular Service. If you are a Pickleball Express employee, contractor, or job applicant, this section does not apply to you in the context of those relationships, and to the extent required by law, our privacy practices are set out in our employee policies or in our agreements with you, as applicable.

What Personal Information We Collect

"Personal Information" is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household.

(Alternatively, you may use PayPal or Amazon Pay to make a purchase and avoid providing credit card information.)

The information we receive from these devices may include IP address, unique device identifiers such as MAC address, usage information, crash data, device performance characteristics and hardware information, battery status, and WiFi network information.

• Audio, electronic, visual, or other sensory information, such as information collected during product demonstration videoconferences with Pickleball Express or any recordings of customer service calls.
• Inferences drawn from the information we collect about you to create a profile about you reflecting your preferences, such as the types of paddles you prefer to play with or purchase.
• Sensitive information, such as your log-in name and password that you use to access your user account on the Services.

• Directly from you. We may collect information from you directly through your use of the Services or other direct interactions with us, such as emails or phone calls.

We may collect your information using automated data collection technologies as described in the "Cookies and Other Data Collection Technologies" section below. For example, we may collect the IP (Internet protocol) address of the device you use to access our Sites and other browsing information, such as page requests, browser type, operating system, and average time spent on our Sites.
• From third parties. We may obtain your information through third-party sources, such as marketing partners, service providers, and social media companies. We may combine this information with the information we collect about you to help us tailor our communications and improve our Services.

(We use Shopper Approved to collect customer product reviews. Shopper Approved may reach out to you for the sole purpose of seeking your opinion on products purchased.)

We may disclose your Personal Information with the following types of third parties:

• Amongst our affiliates and subsidiaries. We may disclose your Personal Information to other entities in Pickleball Express and our affiliates and subsidiaries, in accordance with this Privacy Policy.
• Our service providers. We may disclose your Personal Information to service providers and vendors that perform tasks on our behalf, such as website hosting, customer relationship management, marketing, market research analytics, and product development.

Pickleball Express uses cookies to collect information around abandoned shopping carts. A cart is considered abandoned within one hour of inactivity or lack of purchase. Once the cart is considered abandoned, an SMS message may be sent as a reminder.

As a general matter, we may keep your Personal Information for as long as necessary to fulfill the purpose for which it was collected. We may also retain your Personal Information as necessary to protect or resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Identity Theft

Because the security of our customers is of the utmost importance, we have incorporated Rapid SSL (Secure Sockets Layer) technology to ensure that all credit card and address information entered on our site is fully encrypted and transferred securely to our server.

Identity Resolution

We also engage a third-party partner for the purpose of identifying users and delivering to them marketing on our behalf (e.g., email or direct mail). Our partners may collect information directly from your device, such as your IP address, device ID, and information about your browser or operating system; may combine personal and non-personal information about you with information from other sources; and may place or recognize a unique cookie on your browser. Do Not Track

Some web browsers incorporate a "Do Not Track" or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. However, like many websites, our Site is not currently designed to recognize a "Do Not Track" signal from a web browser. Children's Privacy

Pickleball Express does not knowingly collect personal information from children under the age of 16 using the Site. If you believe a child under 16 years of age has provided us with Personal Information, please contact us at support@pickleballexpress.com with a brief description of your concern.

Information for Users Located Outside of the United States

Notice to Residents of Nevada

If you are a Nevada resident, you have the right to opt out of the sale of certain personal information, including your name and mailing address, to third parties. Pickleball Express does not "sell" your personal information as defined by Nevada law. If that were to change in the future, we will provide Nevada residents with a method to opt out of those transactions.

Third-Party Links

The Sites may contain links to other websites that we do not own or control. If you visit another website, we encourage you to review that website's privacy policy to understand how that website operator will treat your information. Our Privacy Policy does not apply to these other websites.

Pickleball Express uses Shopper Approved to collect customer product reviews. Shopper Approved may reach out to you for the sole purpose of seeking your opinion on products purchased.

If you buy any of our products on Amazon, this Privacy Policy explains how Pickleball Express will process your information. The processing of your information is also governed by Amazon's privacy policy, and we hold on to your data the maximum amount of time needed for payment and tax collection, pick, pack, and shipping which is aligned with Amazon's personally identifiable information (PII) policies.

Notice to California Residents

California residents are entitled to request and obtain from us once per calendar year information about the categories of personal information we have disclosed to third parties for their own direct marketing purposes. To request this information and for any other questions about our privacy practices and compliance with California law, please contact us using the information provided in the Contact Us section below.

This section provides additional information for California residents whose information is subject to the California Privacy Rights Act ("CPRA"). It does not apply to individuals who are not California residents.

We have used and disclosed Personal Information for the business and commercial purposes detailed, respectively, in the "How We Use Your Personal Information" and "How We Disclose Your Information" sections above.

Although we have not "sold" or "shared" personal information for money in the past 12 months, we engage in many standard business interactions with third parties that might be considered a "sale" or "sharing" of Personal Information as those concepts are defined by CPRA. We do not knowingly sell or disclose personal information of minors under the age of 16.

Specifically, we allow third parties to control the collection of Personal Information through cookies and other tracking technologies. These third parties use the data to allow us to understand how the Site is used, to understand your preferences and interests, and to customize advertisements to those interests and preferences. Rights Concerning Your Information

California "Shine the Light" Law. California residents may request information from us once per calendar year about certain Personal Information disclosed to third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have disclosed such information. California residents may also have the following rights concerning our collection, use, and disclosure of their Personal Information:

• Right to Know. You have the right to request information about the categories of personal information we have collected about you, the categories of sources from which we collected the Personal Information, the purposes for collecting, selling, or sharing the Personal Information, the categories of third parties with whom we have disclosed or sold your Personal Information, and the specific pieces of Personal Information we have collected about you.

We may require the agent to provide proof that you gave signed permission to submit the request and may also require you to confirm with us that you provided the agent permission to submit the request or to verify your own identity directly with us. You may also make a request on behalf of your minor child.

We will take steps to verify your identity before completing your rights request. In order to do so, we may ask you to provide additional information, such as your name, home address, and email address. Depending on the nature of your request and our relationship with you, we may request different or additional information, including a signed declaration that you are who you claim to be.

Financial Incentives

From time to time, we may offer financial incentives in exchange for you sharing certain personal information with us. The specific instructions for how to participate and the rewards offered as incentives may vary and are set out within each program. Our good-faith estimate of the value of your information is the value of the benefit we offer to you. We have calculated that value by using the expense to us of operating the program related to the benefit obtained by our running of the program. To participate in any incentive-based programs you can opt in by signing up for the incentive when it is offered to you. Participation in our promotional programs is always optional, and you can terminate program participation at any time as explained in the applicable program terms. At times, it may be necessary for us to make changes to this Privacy Policy. We reserve the right to change this Privacy Policy and any of our policies or procedures concerning the treatment of information. Text Marketing & Notifications

We value your privacy and the information you consent to share in relation to our SMS marketing service. We use this information to send you text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us. Opt-in data and consent for text messaging will not be shared with any third parties except for messaging partners, for the purpose of enabling and operating our text messaging program.
